Thank you very much. 4 At this point, I'd like to defer to President 5 McKay for presentation on the collective bargaining 6 agreement. 7 PRES. McKAY: Thank you chairman. We spent 8 some extensive time with the President of the Guild and 9 with Tom Breedan, who is the president and Jeff 10 Tempera. By the way, welcome to your first board 11 meeting. 12 MR. TEMPERA: Thank you. 13 PRES. McKAY: By the way, Jeff spent 14 thirty-five years in labor management in the County. I 15 dealt with him on three contracts and worked with him 16 on a number of matters; so did a number of employees 17 here at the college, so he brings a world of 18 experience. He's now AVP of employee resources at the 19 college and brings tremendous experience here. 20 At the time of the contract we dealt with 21 negotiations on the Guild on administrative officers. 22 We are in a very difficult time in the county and state 23 and country in regards to budget and financial times. 24 I want to commend the president, and I'll ask for Tom 25 and also Jeff to take us through this process, in any FIVE STAR REPORTING, INC. 631.224.5054 6 1 7/20/11 SCC Board of Trustees 2 negotiations it requires give and take it requires us 3 to face the issues that are before the institution and 4 to put the mission of the college first and foremost 5 while we protect the interests of those that are 6 involved in the direct day-to-day activities. 7 I will ask Jeff to start off first by taking 8 us through the process, and I'll ask the president of 9 the Guild to speak, and I'll give a summation after. 10 MR. TEMPERA: Last May, I think it was, we 11 finalized our negotiations with the Faculty 12 Association. That contract was ratified by the Board 13 and ratified by the County Executive and by the Suffolk 14 County Legislature. This agreement mirrors the terms 15 that we reached with the Faculty Association in a cost 16 concept. That agreement was for a zero zero two two 17 starting in September, 2011 and going forward. 18 The faculty also had ratified what we call 19 the Plus 2 that continued on. The Guild, in following 20 a similar path, again, let me commend Tom and members 21 of the Guild on reaching the agreement because, as 22 President McKay stated, we are in very difficult times 23 in all levels of government and this agreement 24 recognizes the difficult times that we are in because 25 this agreement calls for a zero percent increase in FIVE STAR REPORTING, INC. 631.224.5054 7 1 7/20/11 SCC Board of Trustees 2 salaries the firstyear, zero percent the second year 3 and third year, and in the fourth year of the 4 agreement, it calls for a four percent interest in 5 salaries. 6 It mirrors at the rate, going out rate, the 7 same rate that had been negotiated with the Faculty 8 Association. Rather than the two two in the final two 9 years, we get the cash savings by having an additional 10 zero in the third year, but the rate for membership 11 going out is the same as the Faculty Association. 12 They also opened up their current agreement 13 and gave up the longevity increase for the past year 14 and mirrors the Faculty Association. With the 15 increases in the past, they have taken on the 16 additional responsibility of doing weekend coverage at 17 the college and we have a labor management committee 18 that we have set up to deal with issues that will be 19 ongoing throughout the four years of the agreement. 20 That is basically the nuts and bolts. It 21 does recognize the difficult times that we are in. I 22 want to thank Tom and the membership. I think it 23 passed the membership by close to ninety percent. 24 SPEAKER: A little bit better than ninety 25 percent. FIVE STAR REPORTING, INC. 631.224.5054 8 1 7/20/11 SCC Board of Trustees 2 MR. TEMPERA: Tom and members of the Guild 3 should be commended for negotiating this and bringing 4 this forward. 5 SPEAKER: Basically, I don't have anything to 6 add. I'd like to brag, of course. We rarely beat the 7 Faculty Association. They were only able to achieve 8 two zeros, we were able to achieve three zeros. This 9 stabilizes the cost for the college. Better than half 10 of the members are at the top step. They're well 11 compensated, but they get no raise at all. This almost 12 locks in costs for the middle management group. 13 I represent everyone from the assistant 14 department heads up to the associate deans. That is an 15 important group. They're twelve month employees. Half 16 of them, the chairs, like myself, are ten month 17 employees. The twelve month employees are here on a 18 day-to-day basis. The college and faculty has a large 19 voice in the direction that an institution goes Dr. 20 McKay and his group of people make the policy choices 21 and it's my group's responsibility to carry out those 22 tasks. They do very good job. 23 We appreciate the new contract and it goes a 24 fair way to stabilize costs and we hope that you 25 approve it. Thank you very much. McKAY: I want to thank Tom and Jeff 3 and also Lou who is a member of the bargaining unit. 4 Usually when we have contract discussions, you have a 5 room with about ten to fifteen individuals. As 6 president of the Guild and of the college and having 7 Jeff in labor relations and the lawyer here at the 8 college, we determined that it was in the best 9 interests of the college that we sit directly across 10 the table from each other and address this because time 11 was of the essence. 12 I want to commend Tom for his work. From the 13 beginning when Tom walked in the room, Tom understood 14 what we were faced with. He was able to work with us 15 throughout the entire day. We even ordered lunch right 16 in this room. I paid for it, Tom. We worked right 17 through the day. Tom was very devoted to ensuring that 18 we protected his members and the institution at the 19 same time I want to thank you publicly Tom. Thank you. 20 THE CHAIRWOMAN: Thank you for the report. 21 I applaud the effort of all the parties involved and 22 for the collaborative manner in which you address the 23 this fiscal year. McKAY: With us this morning is 4 Michelle Buchanan from Dini Partners, and Bob Walter 5 who is the president of the Foundation. I believe the 6 Board has given me a charge when the interview process 7 was taking place to find a way to enhance the fund 8 raising effort of this college. The Chairman and I 9 will go back and forth and Michelle will step in. It's 10 a tripod presentation. Michelle came in on the red eye 11 flight this morning, so I want to thank you for your 12 commitment here. 13 Over the past few months we spent extensive 14 time traveling around the county meeting with potential 15 donors that Dini Partners and their team worked 16 together to screen so we can know who the potential 17 partners are or can be forthe college. This is the 18 first time we have done that. We finished the alumni 19 database and I congratulate the team for doing that. 20 Today what you will hear is a presentation 21 from each of us in regards to what we have done since 22 we bought Dini Partners on board. Trustees Hazlitt and 23 Trustee Groneman, who serve on the Board, have gone 24 through a presentation with us on this same discussion. 25 At this time, I'd like to turn it over to Bob FIVE STAR REPORTING, INC. 631.224.5054 11 1 7/20/11 SCC Board of Trustees 2 Walter to speak for a minute then I will have Michelle 3 and I will come back the twenty-five global and what it 4 means to this campaign. 5 MR. WALTER: Under the request and direction 6 of President McKay, the Foundation adopted a resolution 7 to begin a major gift campaign which will take us out 8 to the year 2015. It was initiated in November. We 9 are now in the planning stage. From November through 10 June 30th we gathered statistical data. Dr. McKay and 11 I met with individuals throughout the county, Kevin Law 12 from LIA, Frank Bolton from the Long Island Ducks, Ken 13 Meyers from Clare Rose, all of the individuals that we 14 spoke with. Each and every individual were so positive 15 about what Suffolk County Community College means 16 to the County of Suffolk and to the community itself. 17 Our friend and neighbors, if you talk with 18 anyone, somebody in the family has gone to the 19 community college, our community college. I, as Chair 20 of the Foundation, have been associated with the 21 college for almost forty-five years, feel very strongly 22 that it's the finest community college in the country. 23 And you as trustees should be significantly proud of 24 that fact. 25 I'm pleased to announce that we finally had FIVE STAR REPORTING, INC. 631.224.5054 12 1 7/20/11 SCC Board of Trustees 2 our first chairman's council meeting under the 3 direction of Mr. Bruce Yamali. He was named Chair of 4 the Foundation. Bruce is the proprietary of Dover Food 5 Service and multitude other companies throughout Long 6 Island. Dr. Robert Fry is the Foundation Council's 7 honorary Chair. Dr. Robert Fry is retired from the 8 Renaissance Technology Group, we are all familiar with 9 here on Long Island. We are looking forward to their 10 participation as we go forward into our public phase of 11 planning and moving forward with the Foundation. 12 Very important for me to talk about this 13 process in that we have reached out to the community. 14 We have faculty, we have the administration, we have 15 the Foundation Board of Directors, all on the same 16 train. We are all saying the same thing. I'm looking 17 to the Board of Trustees now to be part of what we are 18 doing as the Foundation. 19 Not everybody has to step up to the plate and 20 say okay, you're going to donate ten or fifty or 21 twenty-five thousand dollars. I don't want to know 22 what that figure is. All I want to know is are you 23 participating. Are you talking about Suffolk Community 24 College like I do. And people step up and say how can 25 I help. That is when we set up a meeting and talk FIVE STAR REPORTING, INC. 631.224.5054 13 1 7/20/11 SCC Board of Trustees 2 about how you can get involved. That individual may 3 reach out to other individuals who have the 4 capabilities to reach out to your foundation. 5 Based on the economic situation in the United 6 States, why do it now? Why not? We have been forward 7 to this stage for many years. When we started the 8 Foundation, we were looking for money to do mailings, 9 now we have about twelve million dollars in our 10 portfolio. That is not enough. Why? We need to 11 enrich the life of our students here in Suffolk County; 12 that is the goal. 13 With that, I would like to introduce Michelle 14 Buchanan. 15 MS. BUCHANAN: Good morning, everyone. I 16 want to take a step back for a minute and talk not only 17 the process but campaigns in general. I come from a 18 strong belief campaigns generate a lot of energy for 19 institutions, and institutions that are serious about 20 changing the way they're perceived in the community and 21 how people look at supporting them financially. 22 This is an opportunity to really set the 23 stage and give a new splash to the college campaigns 24 are not only raising the money and achieving the goal, 25 but it gives us the opportunity to recruit more FIVE STAR REPORTING, INC. 631.224.5054 14 1 7/20/11 SCC Board of Trustees 2 students and make us better known in the community. 3 For community partnerships, it's an opportunity for us 4 to have the faculty, staff, students think differently 5 about how they are engaged in an institution, whether 6 it be through financially supporting it or volunteering 7 their time to make introductions to prospects. This is 8 why I think Dr. McKay and Bob Walter have spent so much 9 time and the Foundation its staff and organizing a 10 campaign effort that will be successful over the next 11 year. 12 Our goal is a seven million dollar goal that 13 we hope to achieve sooner large than later. Over the 14 last few months, there has been a lot of work that we 15 have been doing in terms of sharing the story and 16 making sure everybody understands about changing lives 17 and empowering the community here. We have been 18 looking at building the right team on our Foundation 19 board and including some internal-external 20 partnerships, and branching out. We have been out 21 making some active solicitations and have a couple of 22 gifts that are now going towards that goal we have been 23 doing a lot internally with the staff and preparing 24 with how we move this process. 25 It takes a lot of soldiers to make that work. FIVE STAR REPORTING, INC. 631.224.5054 15 1 7/20/11 SCC Board of Trustees 2 Back on what Bob was mentioning, why now. I think 3 everyone can use the excuse of the economy. Over the 4 last three years, reality is before the last three 5 years people were saying are you sure it's the right 6 time? We would say in any case, if there is a need, 7 it's the right time. There have been needs that have 8 been identified by the college that are important 9 enough to go out in the community and ask them and our 10 family internally to support those efforts. 11 The time is right. There have been several 12 successful campaigns over the last several years in 13 places doing not as well economically as other places 14 in the country. We are going to forge ahead with this. 15 As with any campaign, it's all about the team. The 16 team is not only Foundation, staff, college Board and 17 college leadership, it's everyone around the table in 18 this room. We ask you as the trustees to become part 19 of the excitement to join the team and help identify 20 prospects to cultivate and ask for the give and serve 21 as ambassadors in the community and become familiar 22 with the initiatives and financially support the 23 campaign as well. 24 Again, those campaigns that are the most 25 successful are those that have the leadership to drive FIVE STAR REPORTING, INC. 631.224.5054 16 1 7/20/11 SCC Board of Trustees 2 it. You as the leaders on the trustee side and with 3 Dr. McKay and his team, and Mary Lou and her team, and 4 Dr. Walter and his team, we invite you to become part 5 of the process and join in the fun. 6 PRES. McKAY: I want to commend Michelle and 7 commend Bob as well. When we were out in the discovery 8 phase, we were not at the time actively asking for 9 donations at that time. We got our initial donation of 10 a hundred thousand dollars based on our initial 11 presentation. Subsequently, that same individual give 12 us another one hundred thousand dollars, and over the 13 last few weeks we got another twenty-five thousand 14 dollars, that was before we kicked off the campaign. 15 I believe Suffolk Community College is a 16 premier college. I think nationally we have been 17 recognized in a number of areas. This is the right 18 time for us to move forward on the campaign. The 19 momentum is now. 20 This Friday, the chairman and I were visiting 21 with a prospect on Friday to begin our active 22 solicitation process. We have staff members that have 23 been assigned to council members who will be support 24 for every member on the chairman's council, and I 25 believe we have between fifteen to twenty members. FIVE STAR REPORTING, INC. 631.224.5054 17 1 7/20/11 SCC Board of Trustees 2 With Dini Partners' expertise and with the Foundation 3 staff and with our time, whatever we have left of it, 4 we will be working together driving around the county 5 to make sure that we get the word out to every single 6 constituent. 7 A lot of work goes into this. The prospect 8 and data mining is a lot of work. Dini Partners and 9 Mary Lou and her team have done all the work so far. 10 We have a list of individuals we will be working 11 directly to try to get this campaign moving in the 12 right direction. It is an active campaign at this 13 point. It's in the silent phase, but we are actively 14 moving forward and we hope you will support this effort 15 in the Foundation. BRIGHT: I will bring you the College 21 Association financial report as of June 3, 2011. 22 Currently, the three campus association budgets are 23 doing quite well. We are moving in the final closing 24 of the books. There are some small purchases taking 25 place, things like athletic uniforms and things of that FIVE STAR REPORTING, INC. 631.224.5054 19 1 7/20/11 SCC Board of Directors 2 nature. Ammerman Campus, Grant Campus Association 3 remain in the black. If we look at the Grant Campus 4 and Ammerman Campus child care centers, they remain 5 stable, also in the black. Enrollment remains stable 6 in the summer session. 7 If we look at some of the food services 8 areas, these I'll be referring to the each campus. 9 Peconic Cafe, culinary catering at the culinary arts 10 facility and bakers workshop. Two items I'd like to 11 bring to your attention. The Peconic Cafe, 12 unfortunately, that currently is in the red roughly 13 around fourteen thousand dollars. To give you some 14 explanation regarding that. There were some 15 anticipated repairs that we had to do in that area. 16 One was a compressor that was not budgeted for. 17 Another one, replacement of a temporary employee due to 18 maternity leave. 19 In addition, there are a few more catering 20 events related to the Peconic Cafe. To cover that cost 21 of the accounts being in the red and also the new 22 student orientations, they will be providing the food 23 services. 24 The other item to bring to your attention 25 is the culinary catering. That account is in the red FIVE STAR REPORTING, INC. 631.224.5054 20 1 7/20/11 SCC Board of Directors 2 roughly under seven thousand dollars. I'm happy to 3 mention that that account has a fund balance of 4 thirteen thousand dollars, and also has a contingency 5 fund of ten thousand dollars that will be able to cover 6 the costs. 7 TRUSTEE McMAHON: Why is that in the red? 8 DR. BRIGHT: The catering events that we did 9 out east, to pay for some of the employee costs. 10 TRUSTEE McMAHON: Do we know what the price 11 is for the events going forward? 12 DR. BRIGHT: Most of the cost was made up 13 because of the -- I forget the actual -- dinners that 14 they would have that cause them to -- actually, the 15 cost to pay the staff outweighed what was budgeted. 16 TRUSTEE McMAHON: When they plan the next 17 one, will they take that into consideration, what the 18 actual costs will be you need to take that into 19 account? 20 MR. WALTERS: John Walters, Campus Dean. 21 Yes, it will be taken into account. There has been a 22 total restructuring of the bakers workshop and the 23 retail component will be put in the academic component 24 of the culinary arts facility. That pretty much 25 reflects a two to three month planning process. Yes, the culinary catering 4 piece will be pretty much be taken care of through the 5 student association, which pretty much means all costs 6 will be addressed. 7 PRES. McKAY: Thank you. 8 DR. BRIGHT: The books will be closed August 9 31st. We moved and approved the new fiscal year. I 10 will be bringing you the pre-audit end of year report 11 in September. If everyone requests a monthly financial 12 report, I will be more than happy to share the budget 13 accounts in detail. 14 TRUSTEE MATTACE: We were talking about four 15 million dollars for the Association. I see it's all 16 laid out here when we see these numbers it's flat. I 17 know in our budget, all the information is put there. 18 With the amount of paperwork we get every month, it 19 takes you three hours to go line by line. 20 My suggestion would be when you talk about 21 these kind of numbers, give us a breakdown; it will 22 make it easier for each of the trustees to see where 23 the money is going. We 3 met at the beginning of this year to review practices 4 and policy regarding the accessibility and 5 dissemination and scholarship opportunities for new or 6 continuing students with the purpose of a policy that 7 will enhance opportunities for our students to succeed 8 in their respective. 9 Since then, the committee received a number 10 of documents from the college. We reviewed them and 11 after the review there were some recommendations shared 12 with the college and some further information and 13 documentation requested. We look forward that that 14 information will be provided to us before the next 15 meeting so that we can give a full report to the Board 16 on our recommendations and what we found in terms of 17 the policies in regards scholarships. 18 PRES. I look forward to working new 15 chairperson at this point. We have a lot of work to do 16 before us. 17 The faculty, staff, Guild administrators and 18 our contracts are in place until 2015. We have our 19 deferred maintenance projects in place, we have to 20 begin work on them. We have construction happening on 21 every campus, both in the health and wellness center 22 and the science building here on this campus. 23 I want to ask, can Bill Connors stand for a 24 minute. I call him the resident historian. Bill has 25 been with us forty-four years, at this college. Bob Walter and I stepped foot 14 on this campus in September, 1966. It will be my 15 forty-fifth anniversary this year. My attention is 16 this college, first getting this room called the Alumni 17 Room, which was a battle to begin with, by those 18 trustees. Everything that happened in this college, 19 anybody that has a chance to talk to anybody that 20 graduated from here passed through here have fond 21 memories. My son and daughter both graduated from 22 here. Motion carries. 19 TRUSTEE FENCHEL: More in the nature of an 20 inquiry, I gather in the revised agenda we I did 21 approve the resolutions that were on the prior agenda 22 on the June 23rd agenda. I did join in the approval of 23 those resolutions, but I do have a question. Not 24 necessarily in opposition, but a question to one which 25 is the resolution two zero one one point forty-five FIVE STAR REPORTING, INC. 631.224.5054 29 1 7/20/11 SCC Board of Directors 2 authorizing a contract for executive search services, 3 search services. 4 You are authorizing sixty thousand dollars 5 for an executive search service. In particular ACCT, 6 Association Community College Trustees, for the purpose 7 of an executive search in respect to, I gather vice 8 president and executive vice president for academic and 9 student affairs. 10 While I can understand you do need search 11 services, it seems that sixty thousand dollars for such 12 a search is quite a bit of money. And secondly, why 13 can't we promote from within for that purpose? It 14 seems that this college, which is one of the major 15 community colleges in the country, would have developed 16 enough internal talent that we have little need for an 17 extensive search service. I'm wondering why we are 18 spending that money. 19 THE CHAIRWOMAN: I'd like to refer the 20 concern to President McKay. 21 PRES. McKAY: Certainly. Earlier this year 22 we had a retirement of the vice president of academic 23 and student affairs and we just congratulated Mr. 24 Connors, who will be leaving in seven days. That 25 announcement, Mr. Connors deliberated over and just let FIVE STAR REPORTING, INC. 631.224.5054 30 1 7/20/11 SCC Board of Directors 2 us know at the beginning of the summer. Internally, we 3 did a search for the vice president's position before. 4 It requires faculty, staff, college-wide participation 5 all to be involved in the search process and it takes 6 an inordinate amount of time to get through. 7 Part of it is getting the applications in. 8 It has to be a national search. Then you have go 9 through the formation of committees and screening and 10 all that at the last search for vice president that was 11 unsuccessful. That took us from January all the way 12 probably until the end of June or somewhere in that 13 vicinity. 14 Simultaneously, William B. Connors indicated 15 that he wanting to spend some time off and he wanted to 16 move forward. He was in the lead of that division at 17 the same time. We are down to no one leading the 18 academic division. 19 ACCT is a national firm. Frank Ryan is here. 20 We put a bid out nationally. The reason for the bid is 21 this. These are high level positions. We are the 22 largest community college in the state. We are 23 recognized for academic excellence and we believe that 24 we needed to recruit a top level individual, whether it 25 be here in the state or across the country. FIVE STAR REPORTING, INC. 631.224.5054 31 1 7/20/11 SCC Board of Directors 2 Going back to internal training, we have 3 professional development training here at the college; 4 in fact, I just received a report on my desk this past 5 weekend of a requirement to transform that training we 6 have positioned several individuals in mid-level 7 positions across the college that have gone through the 8 chair's academy. We had Executive Vice President 9 George Gatta go through the SUNY chancellor's training, 10 which is for upper level positions. 11 We are doing everything we can in getting our 12 individuals here the requisite trainings and there are 13 promotions taking place. However, at the vice 14 president level, the talent pool was very light. We 15 didn't get the right type of talent we needed at the 16 last go round. ACCT in the bid process was one of two 17 of four bids and one of two of the lowest bidders in 18 the process, which was thirty thousand dollars per 19 search. When the presidential search occurred, that 20 was around sixty seven thousand dollars for one 21 position. Two firms came in for thirty thousand 22 dollars apiece for both searches. 23 ACCT is the one most eminently qualified. We 24 checked with other firms. They did searches only up to 25 the financial aid director position. ACCT does FIVE STAR REPORTING, INC. 631.224.5054 32 1 7/20/11 SCC Board of Directors 2 president and vice presidential searches. They have 3 the ability to appoint individuals who are former 4 presidents or former vice presidents in an interim 5 capacity. We open for school August 29th. We are 6 wearing many hats right now. We need to move forward 7 now, not to rush the process, because we need to have 8 an open and transparent process, but we need to get 9 faculty and staff involved. That will be over the next 10 couple of weeks, into August. 11 The question is, why are we using a firm? We 12 cannot afford to have a failed search at this point. 13 Connors has to go because he served his time. Our 14 former vice president is no longer here. We have no 15 one serving in that capacity. We are making a judicial 16 approach to get the support of a team that has access 17 to almost nine thousand individuals in a database that 18 can come to us that can report as of yesterday where 19 there are nineteen eminently qualified individuals 20 after the initial screening for vice president and 21 there were forty-seven individuals for the associate 22 vice president. 23 So, that has now put us in a position to try 24 and move us along. I hope that answers your question. 25 TRUSTEE FENCHEL: Partially. The retention FIVE STAR REPORTING, INC. 631.224.5054 33 1 7/20/11 SCC Board of Directors 2 of a search company during the presidency proved to be 3 less than satisfactory, without getting into this, 4 because they certainly did not perform the services 5 that they should have performed. Also, what you are 6 telling me that is the typical or extensive search 7 costs thirty thousand dollars. It seems to me that 8 there has to be duplication of a search for these two 9 positions. As a result, I don't understand how it 10 should be two times thirty thousand. There should be 11 some reduction in the amount simply because there has 12 to be duplication of effort. 13 PRES. McKAY: In the bid process, and 14 frankly speaking for that the other firms one was 15 almost ninety thousand dollars and one was slightly 16 less than ninety thousand; that is for both searches. 17 The lowest bid came through. The other one was only 18 financial aid searches, not to the level of expertise 19 that we are seeking here at the college. 20 Understandably, the decision when you go out 21 to public bid, is based upon those who respond based on 22 the RFP process that we put out and the time line and 23 metrics that are involved, and there was a committee at 24 the college that included members of the cabinet that 25 reviewed all proposals and subsequently made a FIVE STAR REPORTING, INC. 631.224.5054 34 1 7/20/11 SCC Board of Directors 2 decision. 3 I believe from the preliminary reports that 4 we have seen ACCT is also handling all the background 5 checks and screening and communication and they were 6 working with the search teams and my office directly 7 throughout the whole process, including salary and 8 everything else. When you look at nationally what is 9 happening in this area, to have folks move across the 10 country to come to Long Island considering the 11 economics and standard of living, we did not get a 12 comparable pool the last time. Now we have nineteen 13 individuals that are eminently qualified and 14 forty-seven for another, it's the first time in the 15 history of the college. 16 We saw faculty that were hired and once they 17 heard about the cost of living, turned down a position 18 here at the college. 19 TRUSTEE PONTIERI: Is some of the issues 20 that we deal with here that we the seeing people, 21 whether it's their contractual salary or scheduling and 22 the dollars that we offer for the position does that 23 make the position unattractive to internal candidates? 24 PRES. McKAY: That is one of the things that 25 we did when we did the recent exempt salary plan. When FIVE STAR REPORTING, INC. 631.224.5054 35 1 7/20/11 SCC Board of Directors 2 I first joined, the word "exempt" meant exempt from 3 everything. When you have people in Tom's unit, Tom is 4 a great president. People do not want to move up. We 5 provide training, we have sessions, in the contract we 6 send faculty off campus to do training as well. There 7 is a lot of opportunity there. 8 The problem is, in the exempt category, there 9 about twenty to twenty-one of us, there are limitations 10 in terms of benefits. We tried to neutralize that to 11 make it more attractive. For faculty to give up 12 faculty rights when they have tenure to go into an 13 exempt position when there is no tenure that is not 14 attractive plan for members of this college to move up. 15 That is one of the sidebars we have to address going 16 forward. 17 TRUSTEE FENCHEL: Can we, as a board, and I 18 appreciate that the search has to be conducted by -- 19 assuming I appreciate it -- that the search has to be 20 conducted by a professional organization and can't be 21 accomplished by internal promotion, is there some point 22 that we, as a board, will be shown the last candidates 23 for these high positions so we can give our input, not 24 necessarily our yes or no. 25 PRES. McKAY: There are public forums that FIVE STAR REPORTING, INC. 631.224.5054 36 1 7/20/11 SCC Board of Directors 2 are going to be held. The Board will be apprised of 3 them. There will be one on each campus and you are 4 welcome to attend at any of the campuses. 5 The next phase, there is an initial screening 6 right now by ACCT. There are two committees that have 7 been formed. One will go for the VP of Academic and 8 Student Affairs and one for the AVP. When that gets to 9 the point where we will invite candidates on campus 10 there will be a brief, we will send you the brief that 11 will indicate the date time an locations, if you are 12 available you are welcome to attend. 13 Certainly after that, the Board will receive 14 an update from my office in regard to the finalists 15 search and where we are. Prior to that, you can attend 16 any of the campus forums. 17 TRUSTEE FENCHEL: Mr. President, with all 18 due respect, don't you think the Board should be 19 intervening a little earlier than just the public 20 hearings? 21 PRES. McKAY: The only time the three 22 finalists are going to be on campus, Trustee Fenchel, 23 are when they are scheduled to be here. If they are 24 out of state candidates, when they come here, they 25 visit all three campuses the same day and they have to FIVE STAR REPORTING, INC. 631.224.5054 37 1 7/20/11 SCC Board of Directors 2 leave at the end of the day. 3 The question is, if the Board wants to meet 4 the candidates, then you talk about the cost. The 5 candidate either has to stay an extra day or we have to 6 fit that in on the day that the candidate is here. 7 That is the process that we normally have. The public 8 forums are open for anyone can attend. 9 If the Board chooses to want to meet the 10 candidates on a different date, that takes the process 11 beyond where we are. I'm not certain that is where we 12 need to go. I think the public forums are the best way 13 to see the candidates responding to faculty, 14 administrators and students and addressing concerns 15 publicly. I think that is the best forum for a vice 16 president of academic affairs or AVP to address the 17 faculty and trustees in a broad forum like I did when I 18 interviewed for president. I think that is the best 19 way to see a candidate and respond to our peers in a 20 forum that includes multiple constituencies. If we 21 eliminate that, you may not see that. That is your 22 decision. 23 TRUSTEE FENCHEL: I certainly don't want to 24 eliminate it, and I don't want to go through the cost 25 of individually produces bodies. Speaking for myself, FIVE STAR REPORTING, INC. 631.224.5054 38 1 7/20/11 SCC Board of Directors 2 I would like to see some of the documentation 3 supporting finalists. I don't think that involves too 4 much of a cost. 5 PRES. McKAY: Not at all. That can be 6 provided to you. I'll make sure that the committee 7 members and chairs of the committees get that out to 8 the Board members. 9 TRUSTEE FENCHEL: Can I be specific about 10 what I would like to see? I'm speaking for myself 11 because there is no resolution. 12 On these finalists, I don't want to see the 13 forty-seven or nineteen. I would like to see not only 14 the resumes, but I would like to see the transcripts of 15 their academic qualifications. I would like to see the 16 confirmations of the recommendations and confirmation 17 of their employment, what they have shown on their 18 resume. 19 PRES. McKAY: The background check, that 20 will come from ACCT. That will give the actual 21 documents as well as a composite of all that has been 22 done by the professional firm checking credentials and 23 on the resume and qualifications. You will have that 24 as well. 25 TRUSTEE HAZLITT: I think that should be FIVE STAR REPORTING, INC. 631.224.5054 39 1 7/20/11 SCC Board of Directors 2 part of a discussion in the points that you want to 3 make should be included in a discussion and whatever is 4 finalized. You are right. 5 THE CHAIRWOMAN: So the documents will be 6 provided to the entire Board? 7 PRES. McKAY: Absolutely. 8 THE CHAIRWOMAN: Finalists transcripts, 9 confirmation of recommendations and transcripts. 10 TRUSTEE MATTACE: I agree with that, but I 11 wouldn't specifically go to any specific groups for 12 documentation. Whatever the documentation the 13 committee gets should cover the whole broad spectrum. 14 As a board, we are all responsible for the end result. 15 You have the authority to hire the individuals. They 16 gave it to; you it's justified. 17 The problem is with your responsibility 18 things happen, and by somebody picking up something 19 that maybe somebody else didn't, we have to protect 20 each other. We talked this over and over again. It 21 winds up slipping through the cracks. I think we 22 should put in a motion to put that in effect that it's 23 permanent going forward for any hire, that we talk 24 about at this level. 25 I think a lot of times we talk about issues FIVE STAR REPORTING, INC. 631.224.5054 40 1 7/20/11 SCC Board of Directors 2 and we say we agree to it and it's not put on paper. I 3 think we need to put it on paper so when we go back we 4 can see that we did this. 5 TRUSTEE FENCHEL: I offer the resolution that 6 any hires, certainly any hires in the exempt category 7 require, prior to any hiring or announcement of any 8 hiring, that we receive reasonable documentation so we 9 can review that hire, and the merits of this hire, and 10 give our input. Whether or not the president chooses 11 to accept it is your prerogative, but we as a board 12 must give our input. We have to see that; that is our 13 responsibility. 14 PRES. McKAY: I appreciate that. If I could 15 speak on the record on that as well. That has been the 16 case. I have sent to the Board members resumes and 17 summative layout of candidates and you have received 18 that. I have received comments from you and I have 19 acted upon the comments. So again, whether or not a 20 resolution is needed, it's happening right now. Any 21 exempt positions that we have, you and not only 22 exempts, you do get reports on hires throughout the 23 system. That is going to come to in your board packet. 24 You have asked for that before the announcement is made 25 towards the college. That has happened. We have received that information recently 4 and we acted on that before we made an announcement to 5 the college community, and we can continue to do that. 6 As a board it's your prerogative to make that 7 determination. 8 TRUSTEE FENCHEL: I have to respectfully 9 disagree Mr. President. The one example which Trustee 10 Mattace pointed out was a situation where a person, we 11 were not given the documentation, the hiring of this 12 person was already announced and we only ascertained 13 that there were certain occasions, if you will, after 14 one of us checked into the background by coincidence, 15 if you will. 16 So we do need a resolution, I believe, and we 17 need a specific procedure and we need to move for the 18 adoption of that resolution. 19 THE CHAIRWOMAN: So I understand, the motion 20 is to adopt a resolution that asks for all of us to 21 receive information on finalists on those documents 22 that we were like to see that would go beyond what we 23 are currently provided. I do see a difference, if that 24 is a motion. 25 TRUSTEE FENCHEL: Definitely. We get 8 everything else including litigation. It's our 9 responsibility. At this point, we have to read it. I 10 have two file cabinets full already. In the meantime 11 it should be put down. 12 Again, we have too many issues and we 13 discussed today that we talked about and said we were 14 going to do and it's not done.
